General Terms and Conditions

The following General Terms and Conditions and any other rules published on our Website (collectively referred to as the “T&Cs”) constitute an agreement between ARTEFACTO ATELIER S.L. (“PSOPHIA”, “we”, “us”, “our”) and you, the visitor, governing your access to and use of all content and functionalities available on the PSOPHIA website and its applications (App), associated microsites accessed through the URL www.psophia.com, related domain names, and any other PSOPHIA website or microsite (collectively, the “Site”).

By visiting the Website, you agree to and consent to the practices described in these General Terms and Conditions. The T&Cs may be amended from time to time, and your continued use of this Website (or any of our other Websites) following such changes shall signify your agreement to be bound by the amended T&Cs.

Persons wishing to use our services must read and accept the policies relating to those services. In particular, we draw your attention to our policies relating to purchase terms and our Privacy Policy. If you are under 18 years of age, you must inform your parent or legal guardian about PSOPHIA’s Privacy Policy before registering to use this Website or any of the services available on it.

Please read the T&Cs carefully and review them regularly. If you do not agree with any changes made to the T&Cs, you must immediately stop using the Website and the Application.

Registration

To use certain services or features available on this Site, you must register. When registering, you are required to provide information about yourself that is true, accurate, current, and complete in all respects. If any of your registration details change, please notify us immediately by emailing info@psophia.com. We may also change registration requirements from time to time.

Your account password must be unique and kept secure, and you must notify PSOPHIA immediately of any breach of security or unauthorized use of your account.

Although PSOPHIA will not be liable for losses caused by unauthorized use of your account, you may be liable for losses incurred by PSOPHIA or others as a result of such unauthorized use.

Eligibility to Purchase

The purchase of goods through ARTEFACTO ATELIER S.L. (“PSOPHIA”) is strictly limited to parties who can legally enter into and form contracts over the Internet in accordance with Spanish law.

To make purchases on the Site, you will be required to provide personal details, including your real name, telephone number, email address, and any other information requested. You will also be required to provide payment details and confirm that such details are valid and correct and that you are the person referred to in the billing information provided.

The Website is available only to individuals and other parties who meet PSOPHIA’s eligibility criteria, who have been issued a valid credit/debit card by a bank acceptable to PSOPHIA, and who have authorized PSOPHIA to process charges on their credit/debit card for the total purchase price of the goods purchased. Products purchased are for personal use or as gifts only and must not be resold or used for commercial purposes. PSOPHIA reserves the right to limit multiple quantities of an item shipped to any customer or address.

By making an offer to purchase products, you expressly authorize us to conduct credit checks and, where PSOPHIA deems necessary, to transmit or obtain your credit card or credit information (including updated information) to or from third parties solely to verify your identity, validate your credit/debit card, obtain initial authorization, and/or authorize individual purchase transactions.

You also agree that we may use the personal information provided by you to carry out appropriate anti-fraud checks. Such information may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

Pricing Policy

Prices applicable are those displayed on the Website at the time of purchase. Prices are shown per product and include VAT (Value Added Tax). Shipping costs will be communicated at checkout. PSOPHIA reserves the right to make changes at any time, including daily updates to products and prices.

Sale Price Adjustment Policy

PSOPHIA does not offer price adjustments on items purchased prior to the start date of a promotion. Once an item has been purchased at a discounted sale price, no price adjustment will be offered if the item is later marked down further.

Orders

All orders are subject to acceptance and availability. Items in your shopping basket are not reserved and may be purchased by other customers.

PSOPHIA offers products for sale that are in stock and available for dispatch from our distribution center. Occasionally, we may be awaiting deliveries from suppliers. Stock received may be pre-allocated to fulfill existing orders based on waiting lists or priority orders. In some cases, we may be unable to deliver selected items due to production issues or quality control problems. In such circumstances, we will notify you by email and refund your payment within 30 days.

If you have registered to receive a notification when a specific product becomes available, we will attempt to notify you by email when it is back in stock. Please note that high-demand items may sell out quickly.

PSOPHIA will retain a record of your transactions for a minimum of one year.

Payment

Payment may be made by Visa, MasterCard, and any other methods clearly indicated on the Website from time to time. You may also choose to pay via PayPal. When selecting this option, you will be redirected to PayPal to log in and confirm the payment before clicking “Pay Now.” Once completed, you will be returned to the PSOPHIA Website or App.

Payment will be debited at the time of placing the order. You confirm that the credit/debit card used is yours or that you have authorization from the cardholder. All cardholders are subject to validation and authorization checks by the card issuer.

If the card issuer refuses authorization, PSOPHIA will not be responsible for delays or non-delivery. If an item ordered is out of stock, you will be notified by email.

We take reasonable precautions to ensure the Website is secure. All card transactions are processed through a secure online payment gateway using SSL encryption. PSOPHIA does not store full credit/debit card details.

Promotional Codes

Promotional codes are non-transferable, have no cash alternative, cannot be used in conjunction with other offers, and must be redeemed within their stated validity period.

Acceptance of Your Order

Once your order has been placed, you will receive an email acknowledging receipt. This does not constitute acceptance of your order.

Acceptance occurs when the products are dispatched and you receive a shipping confirmation email with tracking details. The contract of sale is concluded in Spain, and the contract language is Spanish.

We reserve the right not to accept your order if payment authorization cannot be obtained, shipping restrictions apply, items are out of stock, quality standards are not met, or eligibility criteria are not fulfilled.

If a pricing error is discovered, we will notify you as soon as possible and reserve the right to cancel the order. If payment has already been made, a full refund will be issued.

Insurance and Delivery

Ownership of the products passes to you once full payment has been received and the goods have been delivered.

Products are your responsibility once delivered to the address provided. By placing an order, you authorize PSOPHIA to leave packages without a signature and release PSOPHIA from liability for any loss or damage resulting from this delivery method.

Delivery times are estimates only. All orders will be delivered within 30 days from order acceptance. PSOPHIA is not responsible for delays caused by customs clearance.

Returns

Returns must be made within 15 days. Items must be unused and returned in original packaging. Damaged or used items will not be accepted.

Defective Products

Products are considered defective if received damaged or if a manufacturing defect occurs within one month of purchase. Items damaged through use are not considered defective.

Defective items may be returned within 15 days for a refund or replacement, subject to availability.

Colours

We have made every effort to display product colors accurately; however, we cannot guarantee accurate color representation on all screens.

Repeated Returns

We monitor customer return activity. Excessive returns may be refused at our discretion or result in account closure.

Intellectual Property Rights

All copyright, trademarks, designs, site layout, software, and other intellectual property rights remain the property of PSOPHIA or their respective owners. Unauthorized reproduction or distribution is prohibited and may result in civil and criminal penalties.

Content

All content is provided “as is” and “as available” without warranties of any kind. Use of the Site is at your own risk. PSOPHIA reserves the right to remove content at any time without notice.

User-generated content represents the opinions of the author and not PSOPHIA. By submitting content, you grant PSOPHIA the right to use it for its own purposes.

Non-Commercial Use

This Website is for personal, non-commercial use only. You may not exploit any content for commercial purposes.

Your Activity

You are responsible for your activity on the Site. PSOPHIA reserves the right to restrict or terminate access at its discretion.

General
