The following “General Terms and Conditions” and any other rules published on our Website (collectively referred to as the “TOs”) constitute an agreement between ARTEFACTO ATELIER SL (“PSOPHIA”, “we”, “our”) and you, the visitor, which governs your access to and use of all content and functionalities available on the PSOPHIA website and its applications (App), associated microsites accessed through the URL www.psophia.com, related domain names and any other PSOPHIA website or microsite (collectively the “Site”).

By visiting the Website, you agree to and consent to the practices described in the General Terms and Conditions. The Terms and Conditions may be modified from time to time, and your continued use of this Website (or any of our other websites) after such changes will signify your agreement to be bound by the modified Terms and Conditions.

Those who wish to use our services must read and agree to be bound by our policies related to those services. In particular, we draw your attention to our policies regarding purchase terms and our Privacy Policy. If you are under 18 years of age, you must inform your parent or guardian about PSOPHIA's Privacy Policy before registering to use this website or any of its services.

Please read the Terms of Service and review them often. If you do not agree to any changes made to the Terms of Service, you must immediately stop using the Website and the App.

Record
To use some of the services or features available on this site, you will need to register. When you register, you are required to provide information about yourself that is true, accurate, current, and complete in all respects. If any of your registration information changes, please inform us immediately by writing to info@psophia.com. We may also change our registration requirements from time to time.

The password for the account you provide must be unique and kept secure, and you must immediately notify PSOPHIA of any security breach or unauthorized use of your account.

Although PSOPHIA will not be liable for losses caused by unauthorized use of your account, you may be liable for losses to PSOPHIA or others due to such unauthorized use.

Purchase eligibility
The purchase of goods through ARTEFACTO ATELIER SL ("PSOPHIA") is strictly limited to parties that can legally enter into and formalize contracts on the Internet in accordance with Spanish legislation.

The purchase of goods through ARTEFACTO ATELIER SL ("PSOPHIA") is strictly limited to parties legally authorized to enter into contracts online under Spanish law. To make purchases on the Site, you will be asked to provide your personal information. Specifically, you must provide your real name, telephone number, email address, and any other requested information as indicated. Furthermore, you will be asked to provide payment details that you represent and guarantee are valid and correct, and you confirm that you are the person referenced in the billing information provided.

The Website is available only to individuals and other parties who meet PSOPHIA's eligibility requirements, who have received a valid credit/debit card issued by a bank acceptable to PSOPHIA, and who have authorized PSOPHIA to process one or more charges on their credit/debit card for the total purchase price of the merchandise they purchase. Products purchased by the buyer are for personal use or as gifts and may not be resold, used for commercial purposes, or for any other commercial gain. Furthermore, PSOPHIA reserves the right to restrict the shipment of multiple quantities of an item to any customer or mailing address.

By making an offer to purchase products, you expressly authorize us to perform credit checks and, if PSOPHIA deems it necessary, to transmit or obtain your credit card information or credit information (including any updated information) from third parties for the sole purpose of verifying your identity, validating your credit/debit card, obtaining initial credit card authorization, and/or authorizing individual purchase transactions.

In addition, you agree that we may use the Personal Information you provide to perform appropriate fraud prevention checks. The personal information you provide may be disclosed to a credit reference or fraud prevention agency, which may maintain a record of that information.

Pricing policy
The applicable prices are those shown on the website at the time of purchase. Prices are per product and include VAT (Value Added Tax). Shipping costs will be communicated to the customer at the time of ordering. PSOPHIA reserves the right to make any changes it deems necessary at any time, and may update products and prices daily to reflect new additions to the website.

Offer Price Adjustment Policy
PSOPHIA does not offer Sale Price Adjustments on items purchased before the sale start date. Once an item has been purchased at a discounted sale price, no price adjustment will be offered if a lower price is set for the item.

Orders
All orders are subject to acceptance and availability, and items in your shopping cart are not reserved and may be purchased by other customers.

PSOPHIA offers products for sale that are in stock and available for shipment from our distribution center. Occasionally, however, we may be awaiting shipments from our suppliers. Items received in stock may be pre-allocated to fulfill existing orders based on customer priority established by the Waiting List or for customers who place orders through the Website for immediate delivery. Please note that we may be unable to deliver selected merchandise due to production issues or quality control problems identified when we receive an order for in-stock products. In these circumstances, we will notify you by email and refund your credit/debit card payment within thirty days of notifying you that the merchandise is unavailable.

If you have registered your email address to receive notifications when a specific product appears on our website, we will attempt to notify you by email when the product is available for purchase. Please note that occasionally some products that are in particularly high demand may sell out during this period.

PSOPHIA will store a record of your transactions for a minimum of one year.

Pay
Payment can be made with Visa, MasterCard, and any other method that may be clearly advertised on the site from time to time. You can also choose to pay with PayPal. When you select this option, you will be redirected to the PayPal website at checkout to "Log in" and review the displayed amount before clicking "Pay Now." Once this transaction is complete, you will be returned to the 3INA.com website or the 3INA app. Payment will be debited and cleared from your account at the time of ordering on the 3INA website. You confirm that the credit/debit card being used is your own or that you have been specifically authorized by the credit/debit card owner to use it. All credit/debit cardholders are subject to validation and authorization checks by the card issuer.

If your credit/debit card issuer refuses to authorize payment to 3INA, we will not be responsible for any delays or non-delivery. Occasionally, high demand causes us to run out of certain items. If we are out of stock of an item you have ordered, we will promptly notify you by email.

Sometimes, we are out of stock of an item and it is not expected to be restocked, so in these cases we must cancel the item. If you used a credit/debit card to make the payment, we will not charge you for the item, nor for any taxes, shipping, or handling fees. We take reasonable precautions to make our website secure. All credit/debit card transactions on this site are processed through a secure online payment gateway that encrypts your card details in a secure environment, returning a verification token to PSOPHIA. Therefore, PSOPHIA does not store your credit/debit card details on our systems.

To ensure your shopping experience is safe, simple, and secure, PSOPHIA uses Secure Socket Layer (SSL) technology. Furthermore, we take reasonable precautions, to the best of our ability, to keep your order and payment details secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party gains unauthorized access to any data you provide when accessing or ordering from the Website.

Promotional Codes
Promotional codes are non-transferable and there is no alternative to receiving the benefit in cash. Furthermore, they cannot be used in conjunction with any other promotional codes or offers and must be redeemed within the validity period, if one is provided.

Acceptance of your order
Once you have made your selection and your order has been submitted, you will receive an email acknowledging your order details. This email is NOT an acceptance of your order, but only a confirmation that we have received it.

Order acceptance will be considered to have occurred when the products are shipped, at which time you will receive a second email including your tracking number and confirming that your order has been dispatched. Therefore, the sales contract is concluded in Spain and the contract language is Spanish. Neither our third-party payment processor nor our designated courier has the authority to accept any orders on behalf of PSOPHIA.

We reserve the right not to accept your order if, for example, we are unable to obtain authorization for payment, shipping restrictions apply to a particular item, the item ordered is out of stock or does not meet our quality control standards and is withdrawn, or you do not meet the eligibility criteria set out in the General Terms and Conditions.

Although we make every effort to ensure that the details on our website are accurate, we may occasionally discover a pricing error for a product. If we discover a pricing error for a product in your order, we will inform you as soon as possible. We are under no obligation to accept or fulfill an order for a product that has been advertised at an incorrect price, and we reserve the right to cancel an order that has been accepted or is in transit. If you order a product that is incorrectly priced for any reason, we will email or call you to inform you that we have not accepted your order and/or that the portion of your order relating to that product has been canceled. If you have already paid for the goods, we will refund the full amount as soon as possible. If the goods are recalled while in transit, we will process your refund once we have received the goods.

Insurance and Delivery
You will become the owner of the products from the moment (a) or (b) occurs, whichever is later: (a) we receive payment in full, or (b) we deliver the goods to you.

The products are your responsibility from the moment we deliver them to the address you have provided.

By placing an order, you agree to our Terms and Conditions and confirm that PSOPHIA may leave your package(s) outside its premises at the shipping address you provided without obtaining a signature as proof of delivery. You authorize PSOPHIA to leave the package(s) at the shipping address without obtaining a signature and agree to release and indemnify PSOPHIA from liability for any loss or damage that may result from leaving the package(s) at your shipping address without obtaining a signature.

Please note that we aim to dispatch all orders within 24-48 hours, although this may be longer during sale periods. Delivery times displayed on the website are estimates and should be used as a guide only, starting from the date of dispatch. In any case, we will deliver your goods within 30 days of the date we accept your order. PSOPHIA is not responsible for any delays caused by customs clearance processes in the destination country.

If delivery is delayed due to any event beyond our control, we will contact you as soon as possible to inform you and will take steps to minimize the impact of the delay. Provided we do so, we will not be liable for delays caused by the event. However, if there is a risk of substantial delay, you can contact us to cancel your order, and we will refund any goods you have paid for but not yet received.

Returns
Making a return is easy using our Returns service. All returns must be made within 15 days. For full details on how to return your purchase, please see our Returns policy.

Our Returns Policy
Items must be returned with all original packaging. Returns of damaged or used items will not be accepted and will be returned to the customer.

Please email return@psophia.com if any of your purchases have been delivered without the packaging.

Items must be returned unused, unopened, and in their original packaging, otherwise we will not accept them.

Defective Products
Goods are considered defective if they are received damaged or if a manufacturing defect occurs within one month of purchase. Items damaged as a result of use are not considered defective.

If your item is defective upon receipt, you can return it for a refund. Simply return the defective item(s) to us within 15 days of receiving them. Whenever possible, we will offer to exchange the item. If an exchange is not possible and the same product is still available, we will send you a replacement. If the same product is no longer available, you will be entitled to a full refund.

Colors
We have made every effort to display the colors of our products on the Website as accurately as possible. We cannot guarantee that your computer monitor's display will accurately represent all colors.

Repeated Returns
We offer a flexible returns policy to make your online shopping experience even easier. We track the number of returns made by customers, and repeated returns will be flagged and potentially rejected at our discretion or may result in the closure of your PSOPHIA account.

Intellectual Property Rights
You acknowledge and agree that all copyrights, designs, the Site's look and feel, trademarks, and all other intellectual property rights and materials related to the Content as described herein, including the PSOPHIA Software and all HTML and other code contained on this Website, belong at all times to PSOPHIA and/or are the property of their respective owners. All such Content, including trademarks, designs, and related intellectual property rights mentioned or displayed on this Site that belong to third parties, are protected by federal and state laws and regulations and international treaty provisions. You are permitted to use the Content only as expressly authorized by PSOPHIA and/or its third-party licensors. Any reproduction or redistribution of the aforementioned Content is prohibited and may result in civil and criminal penalties. Violators will be prosecuted to the fullest extent permitted by applicable law. Notwithstanding the foregoing, the copying and use of the aforementioned materials to any other server, location or medium for publication, reproduction or distribution is expressly prohibited.

In addition to the intellectual property rights mentioned above, "Content" is defined as all information, such as the website's appearance ("look and feel"), data files, graphics, text, photographs, drawings, logos, images, sounds, music, videos, or audio files on this website. PSOPHIA attempts to ensure that the information on this website is accurate and complete. PSOPHIA does not warrant or represent that PSOPHIA Content is accurate, error-free, or reliable, or that your use of PSOPHIA Content will not infringe the rights of third parties.
